This chapter critically examines various proposals for liability of a person to defensive harm. Drawing on the idea that there is an important relationship between a person’s liability to be harmed and the enforceable duties that she incurs as a result of posing a threat to others, it demonstrates that no simple account of liability will be successful. As there are many considerations that bear on the duties that a person has, there are many considerations which bear on a person’s (...) liability to be harmed. This general claim is supported through a demonstration both that culpability without causation can ground liability, and that causal contribution without culpability can ground liability. (shrink)

Research on collective emotion spans social sciences, psychology and philosophy. There are detailed case studies and diverse theories of collective emotion. However, experimental evidence regarding the universal characteristics, antecedents and consequences of collective emotion remains sparse. Moreover, current research mainly relies on emotion self-reports, accounting for the subjective experience of collective emotion and ignoring their cognitive and physiological bases. In response to these challenges, we argue for experimental research on collective emotion. We start with an overview of theoretical frameworks to (...) identify a set of three characteristics of collective emotion. Based on research in cognitive and affective sciences, we then examine the corresponding candidate mechanisms. The distinction between the body schema and the body image has become the stock in trade of much recent work in cognitive neuroscience and philosophy. Yet little is known about the interactions between these two types of body representations. We need to account not only for their dissociations in rare cases, but also for their convergence most of the time. Indeed in our everyday life the body we perceive does not conflict with the body we act with. Are the body (...) image and the body schema then somehow reshaping each other or are they relatively independent and do they only happen to be congruent? On the basis of the study of bodily hallucinations, we consider which model can best account for the body schema/body image interactions. (shrink)

This book provides a systematic, philosophically informed account of criminal responsibility. It begins by providing a general account of criminal responsibility based on the relationship between the action that the defendent has performed and their character. It then moves on to reconsider some of the central doctrines of criminal responsibility in the light of that account.

In recent years, there are a number of proposals to consider collision-based soliton computer based on certain chemical reactions, namely Belousov-Zhabotinsky reaction, which leads to soliton solutions of coupled Nonlinear Schroedinger equations. They are called Manakov System. But it seems to us that such a soliton computer model can also be based on solitary wave solution of Maxwell-Dirac equation, which reduces to Choquard equation. And soliton solution of Choquard equation has been investigated by many researchers, therefore it seems more profound (...) from physics perspective. However, we consider both schemes of soliton computer are equally possible. More researches are needed to verify our proposition. (shrink)

Since the publication of Clark and Chalmers' Extended Mind paper, the central claims of that paper, viz. the thesis that cognitive processes and cognitive or mental states extend beyond the brain and body, have been vigorously debated within philosophy of mind and philosophy of cognitive science. Both defenders and detractors of these claims have since marshalled an impressive battery of arguments for and against “active externalism.” However, despite the amount of philosophical energy expended, this debate remains far from settled. We (...) argue that this debate can be understood as answering two metaphysical questions. Yet prominent voices within the debate have assumed that there is a tight relationship between these two questions such that one question can be answered via the other. We defend an alternative ‘wide’ view, whereby mentality is understood as constituted by wide social and cultural factors. Our wide view entails that the two metaphysical questions are separate and should be kept distinct. This suggests that active externalism as understood by prominent voices within that debate requires dissolution, rather than solution. However, if the debate were instead understood as only focusing on the second of the two questions, then there could be a possible future for this debate. (shrink)

In "De anima" 3.5, Aristotle argues for the existence of a second intellect, the so-called "Agent Intellect." The logical structure of his argument turns on a distinction between different types of soul, rather than different faculties within a given soul; and the attributes he assigns to the second species make it clear that his concern here -- as at the climax of his other great works, such as the "Metaphysics," the "Nicomachean" and the "Eudemian Ethics" -- is the difference between (...) the human and the divine. If this is right, we needn't go on a wild goose chase trying to invent a role for the so-called Agent Intellect to play. God moves our intellects as he moves the heavenly spheres, "as a beloved": he constitutes the complete actualization towards which all of our intellectual striving is directed. Aristotle regards such final causation as an efficient cause, but not in a way that would make it part of what we would call the causal processes or mechanisms of human psychology. But, he would insist, it is essential for appreciating who we are and what our place is in the world. (shrink)

Resumen: La presente contribución gira en torno al significado del atentado terrorista del 11 de septiembre de 2001 para la hermenéutica filosófica, en particular la de Gianni Vattimo. El turinés gestó en sus textos de entre 2006 y 2014 una versión nueva de la hermenéutica que se basa en la experiencia de este acontecimiento. Esta nueva hermenéutica estaría atenta al conflicto y a las transformaciones sociales y tendría por núcleo la noción de “evento”, Sin embargo, Vattimo mismo no ofrece una (...) definición operativa adecuada del término. Ante esto, propongo incorporar a la tradición hermenéutica conceptos como “evento” y “milagro”, acuñados por Joseph de Maistre. Se trata de una propuesta de “maistrianización” de la hermenéutica para hacer de ella un discurso viable y fructífero en un mundo violento e inestable. (shrink)

This response deals with seven of the major challenges the commentators have raised to the target article. First, I show that the historical-anecdotal method I have followed has its roots in sociology, and that there is a strong case for the development of a “psychology of history.” Next, the observational data suggesting that intentional cruelty cannot be restricted to humans is rebutted on the grounds that cruelty requires not only an intention to inflict pain, but to do so because that (...) pain would cause the victim to suffer – which requires a theory of mind. Third, in the light of the commentaries, I recognise that not only predation but also intraspecific aggression contributes to the development of cruelty. Fourth, I contrast nativists and environmentalists, the former regarding cruelty as a universal human capacity and the latter holding the view that cruelty is acquired through social learning, and argue that there is an otherworldly quality to the environmentalist view. I then show (the fifth challenge) that the target article does generate testable hypotheses. Sixth is a consideration of the implications of the target article for the re-admission of the concept of evil to the psychological lexicon; and seventh, a consideration of the commentaries which note that the cultivation of compassion is a tool for the prevention of cruelty. The last section of the response replies to questions of detail and rebuts some misrepresentations of my argument. There is an unresolved conflict concerning the normative nature of desire. Some authors take rational desire to differ from rational belief in being a normatively unconstrained attitude. Others insist that rational desire seems plausibly subject to several consistency norms. This article argues that the correct analysis of this conflict of conative normativity leads us to acknowledge intrinsic and extrinsic reasons to desire. If sound, this point helps us to unveil a fundamental aspect of desire, namely, that we cannot desire at (...) will. Unlike belief, however, desire can unproblematically accommodate a notion of instrumental attitude. (shrink)

From 1929 through 1944, Wittgenstein endeavors to clarify mathematical meaningfulness by showing how (algorithmically decidable) mathematical propositions, which lack contingent "sense," have mathematical sense in contrast to all infinitistic "mathematical" expressions. In the middle period (1929-34), Wittgenstein adopts strong formalism and argues that mathematical calculi are formal inventions in which meaningfulness and "truth" are entirely intrasystemic and epistemological affairs. In his later period (1937-44), Wittgenstein resolves the conflict between his intermediate strong formalism and his criticism of set theory by requiring (...) that a mathematical calculus (vs. a "sign-game") must have an extrasystemic, real world application, thereby returning to the weak formalism of the Tractatus. The question whether justice can be completely detached from morality seems to be relevant to the discussion of the issues that surround the execution of witches in Africa. In spite the widespread belief in witchcraft in African societies, it is apparent that part of the West as well as the Judeo-Christian traditions also support this view. However, this does not remove the fact that, there are thousands of individuals who are still sceptical about such belief. This paper agrees with the (...) view of those who believe the existence of witchcraft. Thus, despite the fact that many scholars have written on the existence of witchcraft in Africa, little or no attention has been paid to the question of moral implications of executing witches in Africa. An attempt to fill this gap facilitates an investigation into the nexus between morality and social justice. The fundamental problem now is, is it morally right to kill? Should witches be killed? If witches should be executed, are there moral and legal bases for such killing? How should we account for the question of sanctity of human life? In this paper, effort shall be made to answer these fundamental questions. The methods employed in this research are critical analysis, philosophical argumentation and conceptual clarification. Sustainable development is the global agenda designed to ensure that the world’s climate is not irretrievably damaged and future generations have equal access to the world’s resources for their own development. The institutionalisation of measures to promote sustainable development has however not had unanimous cooperation. This study therefore investigated the attitude of officials at the local government level to topical issues in the sustainable development agenda in Ondo State, Nigeria, as a pointer to entrenched attitudes in the Third World. Prioritisation (...) of issues varied between localities but premium was placed on poverty alleviation more than on climate change or power generation. People were more concerned with the improvement of their general well-being including health. Respondents indicated that most of the topical issues on the sustainable development agenda could be addressed at the local level thereby lending support for the notion that local action can contribute to global action. However, inclusive measures to promote positive action need to be institutionalised. (shrink)

The paper is devoted to the study of humor as an important pragmatic phenomenon bearing on cognition, and, more specifically, as a cooperative mode of non-bona-fide communication. Several computational models of humor are presented in increasing order of complexity and shown to reveal important cognitive structures in jokes. On the basis of these limited implementations, the concept of a full-fledged computational model for the understanding and generation of humor is introduced and discussed in various aspects. The model draws upon the (...) authors ' General Theory of Verbal Humor, with its six knowledge resources informing a joke, and on SMEARR, a sophisticated semantic-network-based computational lexical environment. The relevance of the approach to the interpretation, generation, and cognitive structure of humor is discussed in the broader context of the nature of the cooperative non-bona-fide modes of communication. Drawing on a close reading of Pierre Bourdieu’s works, I offer five lessons for a science of crime and punishment: always historicize; dissect symbolic categories; produce embodied accounts; avoid state thought; and embrace commitment. I offer illustrative examples and demonstrate the practical implications of Bourdieu’s ideas, and I apply the lessons to a critique of orthodox criminology.
